"These Conditions" refers to the standard terms and conditions of service outlined in this document, which, unless the situation dictates otherwise, also includes any unique terms and conditions that the passenger and the company have agreed upon in writing.
"The Passenger" is defined as the individual who accepts the firm's offer or quote for the supply of services or whose order is accepted by the company for the provision of services.
The term "contract" refers to the contract for the provision of transportation services under these conditions.
"The service" includes the service of transport to or from airports or other places as agreed by the company (including any installment of the service or any multiple services) that the company is to provide in line with these conditions.
Any reference in these conditions to legislation or a provision of a statute must be interpreted as a reference to such statute or provision as modified, re-enacted, or extended at the relevant time.The headers in these conditions are for convenience only and will not alter their interpretation.
Terms of carriageThe company's costs are predicated on passengers being available to travel at the scheduled time. Passengers must book their airport transfer in accordance with the check-in timings and standards specified by their airline.
All meetups, with the exception of airport waiting time, are free for the first 60 minutes for airport pickups, 15 minutes for all others, and thereafter $.50 cents per minute. If we pick up from a Toronto address, the driver will wait for up to 30 minutes after the booking time. If we are unable to contact the passenger (by ringing the doorbell and phoning the contact phone number), we will remove the driver, and the passenger will be liable for the entire payment.
At the airport, our driver will meet you at the information counter in the arrivals terminal. The driver will be holding a name board that clearly displays the booking contact's name. You will then be led to a conveniently located car and transported to your destination. The driver will arrive at the airport 30 to 45 minutes after international or intercontinental flights and 15 to 30 minutes after European flights (unless otherwise indicated by the passenger). He will wait at the information desk in the arrivals terminal. The passenger enjoys an additional 30 minutes of free waiting time. If the driver is unable to contact the passenger, he will place a call for them. If the passenger does not show up within 30 minutes, we will yank the driver away and charge the full amount.
If the customer has been waiting at the airport's information desk and has not been able to reach the driver, the traveler should phone the firm to schedule a meeting time. Passengers should not depart the airport without the company's permission, since doing so would be considered a 'no show', and the passengers will be charged the entire payment.
ConditionsThese conditions shall govern the contract to the exclusion of any other terms and conditions subject to which any such quotation is accepted or purported to be accepted, or any such reservation is made or purported to be made, by the passenger. The company shall supply the service, and the passenger shall agree to accept the service in accordance with any quotation or offer of the company that is accepted by the passenger or any reservation of the passenger that is accepted by the company.
A contract will only be formed if the company accepts the reservation, and the following terms will be deemed incorporated into the contract: The passenger acknowledges these terms and conditions by making a reservation or booking with the company, including but not limited to the company's website, via phone, or through any representative agent.
The contract shall be subject to these terms. The company retains the right to alter these terms and conditions at any time and without notice at its sole discretion. Any updated terms and conditions will be posted on the company's website and will take effect one hour after posting.
No reservation submitted by the passenger shall be deemed approved by the company unless and until the company confirms the reservation by sending the passenger an email confirmation of booking. Passengers will only receive a confirmation if they provide the right email address. If no email is received, please call +1 416 856-4336 for confirmation.
The service specifications shall be those set forth in the company's sales paperwork, unless specifically altered in the passenger reservation (if accepted by the company). The service shall be provided solely as specified in the company's price list. Reservations received other than these will be changed appropriately. Illustrations, pictures, or descriptions, whether on the firm's website, brochures, price lists, or other publications, are meant to be used as a guide only and are not binding on the company.
The company reserves the right to make any changes to the service specification that are required to comply with any applicable safety or other statutory or regulatory requirements or that do not materially affect the performance of the services when supplied to the company specification.
Sub-contracting parties are not permitted to make any statements or claims about the service unless the company confirms in writing. In entering into the contract, the passenger recognizes that it does not rely on and waives any claim for breach of any such assertions that have not been substantiated.
